At the trial of a business broker's common law claims arising out of a series of oral and written communications between him and the potential seller of the controlling interest in a corporation, the evidence, viewed in the light most favorable to the broker, was insufficient to warrant the jury in finding that the parties had, either by their words or conduct, entered into an exclusive brokerage agreement under which the seller would have been required to pay a commission to the broker even if a sale of stock were arranged without the broker's participation. [303-305] At the trial of a broker's common law claims arising out of a series of oral and written communications between him and the potential seller of the controlling interest in a corporation, the evidence did not warrant a finding that the broker had performed services for the seller in reasonable reliance on the seller's alleged promise to create an exclusive brokerage.
